Terms and Conditions of Sale

1. General

These Terms and Conditions ("Terms") govern the sale of all products ("Goods") by Frisson Arms ("Manufacturer") and any authorized reseller ("Reseller"). By purchasing, using, or installing the Goods, you ("Customer") agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use the Goods.

2. Acceptance of Goods

The Customer acknowledges that they have had the opportunity to inspect the Goods prior to use and confirm that they are in good working condition and fit for their intended purpose. The Customer assumes full responsibility for the use of the Goods.

3. Limited Warranty

The Manufacturer and Reseller warrant that the Goods will be free from defects in materials and workmanship for a period of 180 days from the date of purchase. This warranty is limited to the repair or replacement of defective Goods at the discretion of the Manufacturer or Reseller. This warranty does not cover normal wear and tear, misuse, accidental damage, or modifications made to the Goods by the Customer or third parties.

4. Disclaimer of Liability

To the fullest extent permitted by law, the Manufacturer and Reseller expressly disclaim any and all liability for any and all damages, injuries, or losses, whether direct, indirect, incidental, consequential, or punitive, arising from the purchase, use, or misuse of the Goods. This includes, but is not limited to, any claims of personal injury, property damage, loss of income, or loss of life.

5. Assumption of Risk

The Customer acknowledges that the use of the Goods involves inherent risks, including but not limited to the risk of serious injury or death. The Customer voluntarily assumes all risks associated with the use of the Goods and agrees to use them in accordance with all applicable laws, regulations, and safety guidelines.

6. Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Manufacturer and Reseller, and their respective officers, employees, agents, and affiliates, from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the purchase, use, or misuse of the Goods.

7. Limitation of Liability

In no event shall the Manufacturer or Reseller's total liability exceed the amount paid by the Customer for the Goods. The limitations set forth in these Terms shall apply even if any remedy provided under these Terms fails of its essential purpose.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of Monroe County, Tennessee.

9. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

These Terms constitute the entire agreement between the Customer, Manufacturer, and Reseller regarding the sale and use of the Goods and supersede all prior agreements, understandings, and representations, whether oral or written.
